Paul is an Associate Attorney with the Firm, working in our commercial litigation and dispute resolution practice. He has comprehensive experience in litigating commercial disputes at all stages of litigation – from filing the lawsuit to monetary judgment collection actions.

His extensive experience as a commercial litigator has equipped him with deep legal knowledge as well as real world experience to help clients resolve their business disputes. He adds value with strategic thinking, clear communication, and a client-centered approach. Paul is also a skilled negotiator with a strong work ethic who understands both the law and the business world.

Practice Experience

  • Secured a victory as lead trial counsel for an apartment complex owner in a tenant’s breach of contract claim for property damage.
  • Successfully defended an insurance company as lead counsel in trial against two fraudulent property damage claims.
  • Won a trade secret dispute through oral arguments on second day as a licensed attorney.
  • Won a motion for summary judgment on 20 minutes notice, through oral arguments, when a colleague was suddenly unavailable.
  • Trial counsel for an auto shop owner on a dispute about maintenance costs for a Porche 911.
  • Ana Cheri Moreland et. al. v. DHR, Inc. dba Divas Bikini Bar and Grill, Cause No. 2018-00602, (Harris Cty.Dist.Ct. June 13, 2018) – drafted motion to set aside default judgment for good cause and alternatively motion for new trial that persuaded the Court to set aside a default judgment in a case regarding name and likeness claims; drafted special exceptions that persuaded the Court to dismiss Plaintiff models’ claims for damages arising out of the appropriation of their images and likenesses on invasion of privacy, negligence, and theft claims.
  • Martin L. Lara and Rosa Lara v. Osiel Lopez, Cause No. 2017-44536, (Harris Cty.Dist.Ct. July 12, 2019) – drafted motion for summary judgment that persuaded the Court to rule in favor of defendant property owner against a tenant who alleged title to the property by virtue of an owner-financed mortgage.
  • Yeldud Properties, LLC v. Berry, 2020 WL 8482930 (Travis Cty.Dist.Ct. Dec. 2, 2020) – drafted and orally argued summary judgment and evidentiary motions that persuaded the Court to grant summary judgment in favor of defendant property management company on plaintiff investor’s fraud, breach of fiduciary duty, and breach of contract claims.
  • Alexis Milan v. Brittany Paul, Case No. 2019CI22882 (Bexar Cty.Dist.Ct. April 1, 2021) – argued motion for summary judgment that persuaded the Court to grant summary judgment in favor of defendant driver as to gross negligence and negligence per se.
  • K. Heartsill LP v. The Phoenix Insurance Company, 6:21-CV-00212 (W.D. Tex. Aug. 1, 2023) – performed research and drafted early draft of motion for summary judgment on multiple first-party claims wherein a mansion on a ranch with slate roof changed owners but was subject to an owner-financing agreement.
  • Benitez v. AmGuard Ins. Co., No. 4:22-CV-03619 (S.D. Tex. Aug. 24, 2023) – drafted response to plaintiff’s motion to compel that persuaded the Court to hold that on appraisal could not be compelled when the fundamental dispute concerned coverage, not valuation.
  • Francisco Villanueva v. AmGuard Ins. Co, Cause No. 2021-52928, (Harris Cty.Dist.Ct. September 8, 2023) – drafted summary judgment motion that persuaded the Court to dismiss all of insured plaintiff’s post-appraisal claims.
  • Linda Spurlock v. AmGuard Ins. Co., 3:2023-CV-00364 (S.D. Tex. Jan. 3, 2024) – drafted conference letter, first draft of 12(b)(6) motion to dismiss which was substantially the same as the motion filed, and the reply that persuaded the Court to grant the motion to dismiss on a plaintiff’s residential first-party property claims, including breach of contract, bad faith, prompt payment, and fraud claims.
  • Southwest Airlines Company v. Liberty Insurance Underwriters, Inc., 3:19-CV-2218-C (N.D. Tex., Sep. 6, 2023 Mem. Op.) – briefed issue related to a “System Failure Coverage Endorsement” under a cyber policy, in support of a winning motion for summary judgment, and issue related to fees and costs.
